Online Store Terms and Conditions – Bloomlite

Terms and conditions of Bloomlite online store are made in accordance with law on Consumer Protection Act (CPA) and with the recommendations of Tourist Association of Slovenia.

The online store Bloomlite is managed by U.P.T., spletna trgovina d.o.o. (company code 8074097000, TAX Code No 50480898).


DELIVERY

Delivery is free inside the Republic of Slovenia, regardless of amount of a purchase. Delivery is made through different delivery services. We aim to deliver within 2-5 business days, depending on a payment method. An agreed delivery time may not be met due to possible traffic jams leading to a delay. For the courier from delivery service to notify you on any changes, we ask you to fill in your correct telephone number when confirming an order.

PAYMENT

Payment is possible on one of the following ways: pro-forma invoice, credit card or PayPal.

Credit card payment online:

Purchase is possible with the following credit cards: Visa, Visa Electron, Aktiva, Maestro and Mastercard. Communication is coded in order to protect credit card information.

Pro-forma invoice:

After confirming an order, a pro-forma invoice is prepared. It contains a transaction account number and a reference number. Transfer information: the transaction account number 6100 0001 8108 889, open at Delavska Hranilnica d.d., Ljubljana; IBAN SI56 6100 0001 8108 889; BIC number HDELSI22.

Summarized:

Payment with cash upon delivery of the ordered products at the selected address.

ORDER AND SUPPLY OF PRODUCTS

A consumer is notified of ordered products in case they are not in stock or cannot be supplied. In case of preliminary payment of the product that cannot be supplied, an order is countermanded and money is returned to the consumer.

 

DELIVERY DATE

Products are delivered within 2-5 business days. If it occurs that the article a consumer has ordered is no longer in stock, the consumer is notified of it within 3 business days since the order.

PRE-ORDER AND SUPPLY OF PRODUCTS

A consumer is notified of estimated time of delivery of pre-ordered products. The estimated time of delivery may vary up to 10 business days.

VALIDITY OF THE OFFER

When purchasing, prices apply at the time of confirmation of the order. All prices include VAT. Prices can change without prior notice. We reserve the right to change technical descriptions and configurations without prior notice. The images are only symbolic and do not always entirely reflect the actual image.

WITHDRAWAL FROM THE CONTRACT

A consumer has a right to withdraw from the contract without giving any reason within 14 calendar days of making a distance contract (i.e. online purchase).
Withdrawal deadline applies in the following instances:
– withdrawal deadline expires within 14 calendar days from the day a consumer acquires a physical possession of the goods, or when the goods are acquired by a third party, selected by the consumer, who is not a transporter
– in case of partial delivery of individual products during a single order, a withdrawal deadline expires within 14 calendar days from the day a consumer acquires a physical possession of the last product, or when it is acquired by a third party, selected by the consumer, who is not a transporter
In order to exercise the right of withdrawal, a consumer must notify the company of the withdrawal from the contract by writing an unambiguous statement about this decision. The written must be sent by mail (U.P.T., spletna trgovina, d.o.o., Zrkovska cesta 46B, 2000 Maribor) or e-mail (info@bloomlite.com). Regardless of the form of withdrawal sent, a consumer is obliged to submit a copy of the receipt. To comply with the deadline withdrawal from the contract, it suffices to send a notice of exercising the consumer’s right to withdraw from the contract right before the withdrawal deadline.

EFFECTS OF WITHDRAWAL

If a consumer withdraws from the contract, the company will repay them all received payments in any event and without unnecessary delay within 14 calendar days since getting a notice on withdrawal from the contract. Repayment is executed with the same payment method as it was used at the time of original transaction, unless specifically agreed otherwise. The company reserves the right to withhold the payment until the returned products are received or until given a proof that the goods are returned – depends on what event occurs first. A consumer returns the goods to the company that delivered it, in any event and without unnecessary delay within 14 calendar days since the day the consumer notified the company of withdrawal from the contract. To comply with deadline, a consumer must return the goods before the end of a 14-day deadline.

GOODS RETURN CONDITIONS

Direct costs of returning the goods shall be borne by a consumer. Products must be unused, undamaged and in original packaging.

MATERIAL DEFECT

Material defect definition. Material defect means:

  • a product does not have properties which are necessary for its normal use
  • a product does not have properties which are necessary for a special use and the use a buyer buys it for; the use is or should be known to a seller
  • a product does not have properties and virtues that are explicitly or silently arranged or prescribed
  • a supplier delivers a product that does not match the pattern or model, unless the latter are shown to inform.

Enforcing material defects

May there be a material defect, a buyer is obliged to inform a supplier about it at their own expense within a statutory time period. A buyer must allow the supplier to examine a product.

Consumer Protection Act more specifically defines the right to enforce material defects.

WARRANTY

The product has a 2-year warranty, starting with the day of purchase.

Implementation of the warranty is feasible with the original receipt within the time-frame of the estimated duration of the warranty on the product. The products are repaired or exchanged free of charge in the event of material or manufacturing defect. The warranty does not include mechanic damages and damages due to carriers (e.g. an air carrier). The subject of the warranty, therefore, are not defects on the product due to its normal use and wear, or its misuse. Equally the subject of warranty are not defects on the product due to casualty, force majeure, or exposure to acids, water or extreme temperatures.

COMPLAINTS

U.P.T. d.o.o. respects the existing consumer protections laws and uses its best effort to establish an effective system of dealing with complaints. A complaint can be submitted by e-mail (info@bloomlite.net) or by writing to the address of the seller (U.P.T., spletna trgovina, d.o.o., Zrkovska cesta 46B, 2000 Maribor). The process of dealing with complaints is confidential.
A seller will seek to do their best to resolve potential disputes in a consensual way. If consensual solution of dispute is not reached, a competent court in the location of the supplier shall resolve any disputes between the seller and a buyer.
Out-of-court consumer dispute resolution
In accordance with the legal norms, U.P.T. d.o.o. is not acknowledging any of court-appointed experts from out-of-court consumer dispute resolution to have jurisdiction in consumer disputes that could be initiated in accordance with the Law on out-of-court consumer dispute resolution.

This regime stems from the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.
